Tachyon z/Assembler for GCC

The Tachyon z/Assembler for GCC is a no-charge feature of the Tachyon z/Assembler. You can download the Tachyon z/Assembler for GCC by agreeing to the license terms on this page. If you already have a license for the Tachyon z/Assembler or Tachyon 390 Cross Assembler there is no need to download this version.

The tas program included with the Tachyon z/Assembler may be used to assemble the output of the Linux for S/390 and zSeries GCC compiler to create object files for use on OS/390, z/OS, or Linux for S/390 and zSeries. To build OS/390 and z/OS programs, you will also need to download the free, open-source C Runtime Library for S/390. The routines in this library must be linked with the object files created by the Tachyon z/Assembler for GCC.

The software that you are about to download is the current demonstration and production version of the Tachyon Assembler Workbench or the Tachyon z/Assembler. The tas program included with the Tachyon z/Assembler may be used by simply agreeing to the terms below. You do not need to purchase a license from Tachyon Software to assemble the output of the GCC compiler using the Tachyon z/Assembler.

1. “Licensor” shall mean Tachyon Software LLC or its assigns. “Licensed Software” or “Software” shall mean the software identified above, all updates and revisions, and all documentation associated therewith.
2. Licensor hereby grants to Licensee, and Licensee hereby accepts, a personal non-exclusive and non-transferrable license to use the Licensed Software for a limited trial period.
3. Licensee acknowledges and agrees that the Licensed Software is Licensor’s exclusive property and constitutes a valuable trade secret of Licensor. Upon the expiration of the term hereof, the Licensed Software shall automatically become disabled.
4. The Licensor is not liable for any problems or damages associated with the Licensee’s programs which were assembled using the Licensed Software. The Licensee is solely responsible for testing their programs and ensuring adequate backup and recovery of their data.
5. THE LICENSED SOFTWARE IS PROVIDED ON AN “AS IS” BASIS, AND THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. LICENSEE SHALL BE SOLELY RESPONSIBLE FOR THE SELECTION, USE, EFFICIENCY AND SUITABILITY OF THE LICENSED SOFTWARE AND THE LICENSOR SHALL HAVE NO LIABILITY THEREFOR.
6. IN NO EVENT SHALL LICENSOR BE LIABLE TO LICENSEE FOR ANY INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES OR LOST PROFITS, ARISING OUT OF OR RELATED TO THIS LICENSE OR THE PERFORMANCE OR BREACH THEREOF, EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY THEREOF. LICENSOR'S LIABILITY TO LICENSEE HEREUNDER, IF ANY, SHALL IN NO EVENT EXCEED THE TOTAL OF THE LICENSE FEES PAID TO LICENSOR HEREUNDER BY THE LICENSEE.
7. IN NO EVENT SHALL LICENSOR BE LIABLE TO LICENSEE FOR ANY DAMAGES RESULTING FROM OR RELATED TO ANY FAILURE OF THE SOFTWARE, INCLUDING, BUT NOT LIMITED TO LOSS OF DATA.
8. LICENSOR SHALL HAVE NO LIABILITY TO LICENSEE FOR THE INFRINGEMENT OF PROPRIETARY RIGHTS BY THE LICENSED SOFTWARE OR ANY PORTION THEREOF.
9. THE LICENSEE MAY NOT, FOR ANY REASON OR PURPOSE, ATTEMPT TO OR ACTUALLY REVERSE ASSEMBLE OR REVERSE COMPILE THE LICENSED SOFTWARE OR ATTEMPT TO DEFEAT TIME LIMITS OR OTHER RESTRICTIONS PRESENT IN THE SOFTWARE.
10. These terms and conditions constitute the complete and final agreement between the parties and supersedes all prior or contemporaneous oral or written negotiations or communications with respect to its subject matter.
11. In the event of any default under the terms of this Agreement, the non-defaulting party shall be entitled to its remedies at law or in equity and shall also be entitled to its attorneys' fees and costs in the enforcement of this Agreement.
12. The validity, construction and performance of these terms and conditions are governed by the laws of the State of Colorado. Suit with respect to this Agreement may be brought only in a Colorado Court of competent jurisdiction.
